PCU_/FAP Freedom of Information Act Request re_ Delegation of Authority & 'Group Use' policies for 2010 Rainbow Gathering: The Delegation of administrative powers to Incident Command for every gathering is always of concern; the decision to accept cooperation on an Operation Plan in lieu of a signed permit is of special interest this year. FOIA Request to Allegheny N.F., faxed 6/28/10.
from USFS Eastern Region (NFS and LE&I, Milwaukee) to ANF Supervisor...
6/14 Delegation in-turn, from Supervisor to Bradford District Ranger as a
nominal 'NFS' Incident Commander, in tandem to the real Incident Commander
from 'LE&I', the lead agency on the "National Incident Management Team".
(3 pp. total... conveyed personally on 7/6/10, at ANF headquarters in Warren, PA. )
This is different from such 'Delegations' in previous years, where the Supervisor
transferred admin powers to the I.C. It is also the first time 'Group Use' policies
have been addressed within its scope, and most unusual that it allows flexibility
on the signed permit requirement.

7/13 Response Letter from ANF, received by postal mail a couple weeks later, in re: 'Delegation' conveyed personally on 7/6/10... no further disclosures are provided.

7/30 'Second FOIA Request" to ANF, for items NOT provided on original Request of 6/28 -- faxed and emailed on 8/2/10.

7/23 Response Letter from ANF, with additional disclosures included. This was not received until 8/5, so when the 2nd Request went out 3 days before, it was unknown that three more documents were en route:
The "Incident Action Plan" for the "2010 National Rainbow Family Gathering",
effective June 22, 2010. Included are an 'Organization' chart for the 2010 Incident Team,
staff Assignment Lists, radio protocols, 'Scene Visitation Guidelines', and contact info
for regional medical, health, & emergency agencies. Where 'Incident Command Agency
Representatives' are listed, only local police & EMA departments are shown - no local
civilian agencies or other Federal agencies are identified on the "Team". (21 pp. 758 kb)
The "Operation and Maintenance Plan" signed by the Forest Supervisor on 6/28/10.
This time, it is for the "2010 Peaceful Assembly"... unlike previous Op Plans,
'Rainbow Family' is not referenced as a party to these terms. (6 pp., 190 kb)
The "Rehabilitation Plan" dated 7/3/10, for the "2010 National Rainbow Family Gathering"...
oops, the 'Rainbow Family' is the named group party again. (2 pp., 70 kb)
8/06 Response Letter (#3), in answer to the Second Request dated 7/30, simply noting that the above documents had been sent and should have been received... (O-kay...).
Coincidentally (?) the same day I emailed the FOIA Coordinator -- confirming receipt of these docs the day before, and advising that we would "...clarify or amend the Second Request accordingly."

8/13 "Amended Second FOIA Request" to ANF, supplanting the prior 2nd Request in light of 3 new items received. It pins down documents still outstanding on the application and formation of special use policies for the 2010 Gathering.
