Case docs from the 'Group Use' permit defense of Ben Masel, cited at a regional gathering in Wisconsin, August 1998. This defense went forward with a pre-trial Motion for dismissal filed in February '99, which the Court denied in its June '99 ruling. PCU_/Free Assemly Project went to Madison to assist with the trial... this memo was conveyed to Masel and his attorney the day before. It anticipated the arguments and facts needed to balance the defects in the pre-trial record – especially the implications that "Rainbow Family" was a 'Group' under this regulation – and offered further testimony to put the defense on a stronger footing. Strider had successfully defended his NGU citation from the Arizona '98 Rainbow Gathering (U.S. v. Linick, Cr.# 98-502-1-PCT-RGS, Dist. Ariz.). Masel appealed the Magistrate's pre-trial ruling and trial conviction to the District Court... (Briefs to be obtained). The District Judge issued this ruling in March 2000, upholding the conviction.
